This website and the associated services are operated by Halaal Tech (Pty) Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Halaal Tech (Pty) Ltd. We offer this website and our digital platforms, including all information, tools, and services available, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

You must not transmit any worms, viruses, or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service for lawful, operational, security, or compliance-related reasons.

You understand that your content and data (not including credit card information), may be transferred unencrypted and involve – (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You must not transmit any worms, viruses, or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

4. Section 3 - Accuracy, Completeness and Timeliness of Information

We are not responsible for any information made available within the Service, including the Halaal Database (HDB), as we make no representations or warranties regarding the accuracy, completeness, reliability, or certification validity of any information made available through the Service, including the Halaal Database. The material and data within the Service are provided for general information and operational support and should not be relied upon as the sole basis for making critical certification decisions without consulting primary sources. Any reliance on the material within this Service is at your own risk

The Service may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of our Service at any time, but we have no obligation to update any information.

The Service does not constitute legal, regulatory, or religious advice. Users must obtain independent verification from relevant certification bodies before making any certification, commercial, or compliance-related decisions.

SECTION 3A – ROLE OF HALAAL TECH

Halaal Tech (Pty) Ltd is a technology service provider and does not act as a halaal certification authority. All certification decisions, approvals, and endorsements remain the sole responsibility of the relevant independent halaal certification body.

Halaal Tech does not:

a)    Issue halaal certifications

b)    Validate religious compliance decisions

c)     Assume responsibility for certification outcomes

Users acknowledge that:

a)    The platform facilitates data management and operational processes only

b)    Any reliance on certification status must be verified directly with the issuing certification body

SECTION 3A – ROLE OF HALAAL TECH

5. Section 4 - Modifications to the Service and Prices

Prices for our Services are governed by your specific subscription or commercial agreement with us.

 

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, suspension, or discontinuance of the Service.

6. Section 5 - The Services

Our Services, including the Halaal Management System (HMS) and Halaal Database (HDB), are available exclusively through a subscription.

 

We reserve the right, but are not obligated, to limit the sales of our Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.

 

We do not warrant that the quality of the Services, information, or other material obtained by you will meet your absolute expectations, or that any errors in the Service will be corrected. We do not guarantee uninterrupted or continuous availability of the Service. The Service may be subject to temporary interruptions due to maintenance, updates, or technical issues.


  • All prices, as applicable, are exclusive of taxes.

  • Where unlimited data records are indicated, such is subject to a Fair User Policy of 100 000 records per component.

7. Section 6 - Subscription, Billing and Account Information

We reserve the right to refuse or terminate any subscription. We may, in our sole discretion, limit or cancel access.

 

You agree to provide current, complete, and accurate subscription and account information for your entity. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

8. Section 7 - Third-party links and tools

Our Service may include materials from or links to third-party websites or tools that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials, websites, or services.

 

Complaints, claims, or questions regarding third-party products should be directed to the third-party.

9. Section 8 - Feedback and Submissions

If you send creative ideas, suggestions, proposals, or other materials (collectively, 'feedback'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, and otherwise use in any medium any feedback that you forward to us. We are under no obligation-


(1) to maintain any feedback in confidence;

(2) to pay compensation for any feedback; or

(3) to respond to any feedback.

10. Section 9 - Personal Information

Your submission of personal information through the Service is governed by our Privacy Policy. We process personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA). By using the Service, you consent to:


  • the collection and processing of personal and organisational data required for platform functionality;

  • the storage of such data on secure cloud-based infrastructure;

  • cross-border data transfers where necessary to operate the Service.


SECTION 9A – DATA OWNERSHIP AND USE

Certification bodies and users retain ownership of the data they upload to the Service.


Halaal Tech retains ownership of:

  • all system architecture, software, and platform infrastructure;

  • aggregated, anonymised, and system-generated data.


Halaal Tech may use anonymised and aggregated data for:

  • system improvement and development;

  • analytics and performance optimisation;

  • industry insights and reporting.


Upon termination of the Service, Halaal Tech reserves the right to retain or delete data in accordance with its data retention policies.

11. Section 10 - Prohibited Uses

In addition to other prohibitions, you are prohibited from using the site or its content:


(a) for any unlawful purpose;

(b) to solicit others to perform or participate in any unlawful acts;

(c) to violate any international, federal, or local regulations, rules, or laws;

(d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;

(e) to submit false or misleading information;

(f) to upload or transmit viruses or any other type of malicious code;

(g) to collect or track the personal information of others;

(h) to spam, phish, pharm, pretext, spider, crawl, or scrape data from our Service;

(i) for any purpose inconsistent with our Shari'ah compliance mandate; or

(j) to interfere with or circumvent the security features of the Service.

 

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

12. Section 11 - Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable. Halaal Tech does not warrant that any outputs, reports, certificates, or system-generated results produced by the Service are free from error or suitable for certification or regulatory reliance.

 

Without limiting the generality of the above, Halaal Tech (Pty) Ltd shall not be liable for:

 

a)    any certification decisions made using the Service;

b)    any reliance placed on data, records, or outputs generated by the Service;

c)    any regulatory, legal, or Shari’ah non-compliance arising from use of the Service;

d)    any inaccuracies or omissions in certification data provided by third parties or certification bodies

 

In no case shall Halaal Tech (Pty) Ltd, our directors, officers, employees, affiliates, agents, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, arising from your use of the Service. Our total aggregate liability to you shall be limited to the subscription fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

13. Section 12 - Indemnification

You agree to indemnify, defend and hold harmless Halaal Tech (Pty) Ltd and our parent, subsidiaries, affiliates, partners, officers, and directors from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.

14. Section 13 - Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.


SECTION 13A – FORCE MAJEURE

Halaal Tech shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to acts of God, internet outages, cyber incidents, governmental actions, or failures of third-party service providers.

15. Section 14 - Termination

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.
